The incredibly succinct title of the conference
This evening I was able to attend a conference held just outside the Northwest University of Politics and Law in Xi'an where Jillian is interning this summer, which went by the zippy English title of "International Academic Seminar on Positive Interaction of Judicature and Media".

The most interesting speaker, to me, was Ed Wassaby ( unsure of spelling ) who spoke on the role of the media in the U.S. and how it often occupies the same "space" as the courts in it's view of fact gathering and truth finding; which often results in struggle if the it's view and the view of the court are not in complete parallel. This struggle, Wassaby maintains, results in the media taking one of four types of approaches to the court.
1. collaborative
2. adversarial stalemate
3. subordinate
4. wielding power over the court
The latter has been the case, he maintain, in the case of the 2000 election in which the media first declared Bush the winner and also created the illusion or at least false immediacy of a "constitutional crisis". Both of these themes played out heavily in the subsequent Supreme Court decision.
The next case which was discussed involved the current debacle of the Rove/Novak leak, in which a reporter has already been jailed for not revealing sources. This would be demonstrative, some would argue, of the need for a Federal version of a Shield Law which many states have to protect journalists in such a case, and give them special exemption to the orders of the court to reveal information if it does not relate directly to matter of national security, etc.
The question quickly becomes, however, who exactly would this law cover - or do the present state laws really cover - in the day of blogs as a quickly expanding source of news. Are bloggers journalists in the former sense of the word and deserving of this kind of protection? Thoughts?
